You understand and agree that Nyrapay is able to carry out further due diligence procedures in order to satisfy its own due diligence requirements and to comply with applicable legal responsibilities. You acknowledge and agree that Nyrapay may perform due diligence on You, Your business, and Your activities, among other things, and that You will supply Nyrapay with the required documentation before any Services under these Terms begin. As needed by the applicable laws, Nyrapay shall have the right to share the KYC papers and other relevant papers with the Facility Providers, governmental bodies, or law enforcement organizations. You hereby specifically authorize Nyrapay to use the KYC Documents that you have submitted in order to provide Services. You also understand and agree that Nyrapay retains the right, at all times, to keep an eye on, evaluate, retain, and disclose any information related to the Service in order to comply with applicable laws, court orders, or governmental requests.
Compliance with Payment Aggregator Guidelines
You need to create a thorough system for processing client grievances that outlines how to handle complaints from customers and includes the identity of the person you have assigned to handle these complaints. It has been made clear that this kind of customer grievance redressal system will enable users to file complaints using phone, email, or any other technological method. You have five business days from the date of receipt to address any complaints or grievances that you receive from your consumers. You alone will be in charge of addressing or classifying any complaints that are made against you. To ensure compliance with the PCI DSS, as it may be updated from time to time, and the Payment Application-Data Security Standard (PA-DSS), if applicable, you must either comply with it or enter into an agreement with a third-party service provider of payment processing services. You will also need to provide written reports to Nyrapay each year as evidence of your compliance to the relevant requirements.
Payment
Update your GST registration number on the Nyrapay dashboard before Nyrapay issues the invoice. You are also only liable for submitting the GST certificate as part of the KYC process. Based on the information you supply, Nyrapay will create a GST tax invoice and report the transactions in the GST returns. In order to allow You to claim the relevant input tax credit, the GST returns will be filed in accordance with the legal time frames. Any error or misrepresentation on your side when changing the GST number and other information in accordance with the GST certificate disclaims Nyrapay's liability.
Waiver
Any term of these Terms or associated right that Nyrapay fails or delays to enforce or execute shall not be regarded a waiver of such provision or right by Nyrapay. No right or action that Nyrapay may have under these Terms, at law, or in equity shall be lost or prevented from being exercised by Nyrapay in conjunction with the exercise of one or more of its rights under these Terms. Any waiver of any clause must be made in writing and signed by a Nyrapay officer with the appropriate authority in order to be effective.
Disclaimer of Warranty
Nyrapay promises that the service will be provided largely in compliance with the service guidelines that are posted on the website. Nyrapay guarantees that the Service will function in line with these Terms in all material ways. The Services are offered "as is," to the best degree allowed by Applicable Laws, and save as specified in these Terms. You understand that Nyrapay makes no guarantees regarding the availability of the Services, their accuracy, or their suitability for Your particular business needs.

Suspension and Termination

Additionally, You acknowledge and agree that in the event of a termination, We will not be responsible for paying You any money, providing payments, or covering losses resulting from Your use of the Services, or from the termination, suspension, or deletion of Your information or account data. You will still be responsible to Us for any costs, penalties, or other liabilities paid by You as a result of Your use of the Services prior to termination.
